The Law “On Prevention of Infectious Diseases” has entered into force in Turkmenistan. The document signed by President of Turkmenistan Gurbanguly Berdimuhamedov has been published in the country’s newspapers.
“This law defines the legal, organizational, economic and social basis for the prevention of infectious diseases,” the preamble says.
The law defines such concepts as infectious diseases, isolation, epidemic, immuno-biological drugs, quarantine, surveillance, preventive vaccinations, post-vaccination complications, sanitary and quarantine control, etc.
According to the law, the bodies that carry out state regulation and control in the field of prevention of infectious diseases are the Cabinet of Ministers, the Ministry of Health and Medical Industry of Turkmenistan (hereinafter referred to the authorized body), as well as other ministries, departments and authorities within their competence.
This Law applies to citizens of Turkmenistan. Foreign citizens and stateless persons residing or staying in the territory of Turkmenistan enjoy the rights and bear their obligations defined by this law.
The law stipulates that financing in the field of prevention of infectious diseases is carried out at the expense of the State Budget of Turkmenistan, as well as other sources not prohibited by the country’s legislation.
Preventive vaccinations included in the National Vaccination Procedure and preventive vaccinations for epidemic indications are carried out for citizens free of charge at the expense of the State Budget of Turkmenistan and other sources not prohibited by law.
According to the law, the decision to carry out preventive vaccinations for epidemic indications is made by the head of the State Sanitary and Epidemiological Service, and the procedure for preventive vaccinations, the timing of their implementation and the categories of citizens related to mandatory vaccination are approved by the Ministry of Health and Medical Industry of Turkmenistan.
The document defines the procedure for establishing quarantine and entry into the territory of Turkmenistan of persons, vehicles, import of goods, goods and other items that may be factors of infection transmission.
The law also warrants social support for citizens in the event of post-vaccination complications.In these cases, citizens are entitled to receive one-time monetary assistance, monetary compensation and benefits for temporary disability.
In the event of a citizen’s death due to a post-vaccination complication, the right to receive a one-time monetary assistance is granted to members of his family.
In addition, the state guarantees social protection of employees of health care institutions in the field of prevention of infectious diseases. The franchise application of this category of employees is carried out in accordance with the legislation of Turkmenistan, regardless of the length of working hours.
Persons guilty of violating this law are liable in accordance with the procedure established by the legislation of Turkmenistan. The law comes into force from the day of its official publication.
